These Terms of Service (“Terms”) govern your access to and use of Mosie's websites, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, you should not use the Service, though you may have already done so by the time you read this.

Who we are

References to “Mosie,” “we,” “us,” or “our” refer to the entity or entities operating the Service, which may change from time to time without notice. The Service may be offered under different names, brands, or domains now or in the future.

Eligibility

You represent that you have the legal capacity to enter into these Terms, or that you have obtained any consent required for you to use the Service. The Service may not be available in all locations, and we may restrict access at our discretion.

The Service

Mosie provides tools that may help users study, organize materials, and interact with AI-assisted features. The Service is provided for general educational and personal use unless we state otherwise. Features may be added, modified, suspended, or removed at any time, with or without notice.

We do not guarantee uninterrupted availability, specific outcomes, academic results, or compatibility with any particular curriculum, exam, institution, or grading standard.

Accounts

You may need an account to use certain features. You agree to provide information that is accurate to the best of your knowledge and to keep your credentials secure. You are responsible for activity that occurs under your account, whether or not authorized by you. We may suspend or terminate accounts that we believe violate these Terms or pose risk to the Service or others.

Your content

You may submit or upload content to the Service, including documents, text, prompts, and other materials (“User Content”). You retain any rights you may have in User Content, subject to the licenses described below.

By submitting User Content, you grant Mosie a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, adapt, publish, display, and distribute such content as reasonably necessary to operate, provide, improve, and promote the Service. This license may survive termination of your account to the extent necessary for backup, legal, or operational purposes.

You represent that you have the rights needed to submit User Content and that doing so does not violate any law or third-party rights. We are not obligated to monitor User Content but may remove or restrict content at any time.

Acceptable use

You agree not to use the Service in ways that:

  • Violate applicable laws, regulations, or third-party rights;
  • Involve cheating, academic dishonesty, or misrepresentation of authorship;
  • Attempt to bypass security, access controls, or usage limits;
  • Introduce malware, scrape excessively, or disrupt the Service;
  • Harass, exploit, or harm others;
  • Use the Service for unlawful, harmful, or unintended purposes.

This list is illustrative, not exhaustive. We may determine acceptable use in our discretion.

AI-generated output

The Service may produce AI-generated quizzes, explanations, summaries, or other outputs. Such outputs may be inaccurate, incomplete, outdated, or inappropriate. You are solely responsible for how you use generated content and for verifying information before relying on it for academic, professional, or other purposes. Mosie does not warrant that outputs are correct, original, or free from third-party claims.

Third-party services and links

The Service may integrate with or link to third-party services, models, or content. We do not control and are not responsible for third-party offerings. Your use of third parties may be subject to their own terms and policies.

Intellectual property

The Service, including its design, branding, software, and underlying technology, may be protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written consent, which we may withhold for any reason or no reason.

Feedback

If you provide suggestions, ideas, or feedback, you grant us the right to use them without restriction or compensation, to the extent permitted by law.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSIE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSIE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) AN AMOUNT WE MAY DETERMINE IN OUR SOLE DISCRETION, SUBJECT TO APPLICABLE LAW.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Mosie and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Provisions that by their nature should survive termination may survive, including disclaimers, limitations of liability, and indemnification.

Changes to these Terms

We may modify these Terms at any time. Updated Terms will be posted with a revised “Last updated” date. Your continued use of the Service after changes take effect may constitute acceptance, unless applicable law requires a different process.

Governing law and disputes

These Terms shall be governed by laws that we deem applicable, without regard to conflict-of-law principles, except where mandatory local law provides otherwise. Disputes arising from these Terms or the Service may be resolved in forums we designate, unless prohibited by applicable law. You waive any objection to such jurisdiction or venue to the extent permitted.

General

These Terms constitute the entire agreement between you and Mosie regarding the Service to the extent they supersede prior understandings on the same subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
